ALLRANGEKIT TERMS AND CONDITIONS

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY IN THEIR ENTIRETY BEFORE USING THIS PLATFORM OR ANY SERVICES MADE AVAILABLE USING THE PLATFORM. BY CLICKING "I ACCEPT," OR BY ACCESSING OR USING THE PLATFORM, YOU ACCEPT AND AGREE TO BE BOUND AND ABIDE BY THESE TERMS AND CONDITIONS.
IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS, YOU MUST NOT ACCESS OR USE THE PLATFORM.
THIS AGREEMENT CONTAINS PROVISIONS THAT LIMIT OUR LIABILITY TO YOU AND REQUIRE YOU TO RESOLVE ANY DISPUTE WITH US THROUGH FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS, AND NOT BY A LAWSUIT OR RESORT TO COURT PROCESS.
THIS MEANS THAT (I) YOU ARE GIVING UP, AND YOU WAIVE, THE RIGHT TO HAVE ANY SUCH DISPUTE DECIDED IN A COURT OF LAW BEFORE A JURY OR A JUDGE (EXCEPT AS SET FORTH EXPRESSLY IN SECTION 22), AND (II) THAT YOU ARE GIVING UP, AND YOU WAIVE, THE ABILITY TO PURSUE ANY SUCH DISPUTE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. PLEASE SEE SECTIONS 20, 21, AND 22 FOR MORE INFORMATION.

1. OUR ROLE AND ACCEPTANCE OF THESE TERMS AND CONDITIONS
Welcome to the website and mobile applications operated by Open Healthcare US, Inc. d/b/a AllrangeKit™ ("AllrangeKit," "OHUS," "we," "us" or "our"). The following terms and conditions ("Terms and Conditions" or "Terms") govern your access to and use of:
(i) allrangekit.com and any other websites which are owned or operated by AllrangeKit™ or its affiliates (the "Sites").
(ii) Any other digital interfaces and properties (e.g., mobile applications) owned, controlled by, or made available to you by AllrangeKit™ or its affiliates ("Mobile Apps," and together with the Sites and other online or mobile-enabled technology, digital tools, the "Platform").
(iii) Any services and products that you may access through the use of the Platform (such services and products, the "Services").
The Services available through the Platform include:
- At-home laboratory test collection kits for various health conditions including but not limited to:
• Sexually Transmitted Infections (STI) testing
• Human Papillomavirus (HPV) testing
• Gastrointestinal (GI) tract pathogen testing
• Urinary Tract Infection (UTI) testing
• Other wellness and diagnostic tests as offered
- Access to laboratory services performed by CLIA-certified clinical laboratories (collectively, "Labs")
- Access to healthcare practitioners ("Practitioners") for test authorization and result review
- Telehealth consultations related to test results
- Educational health and wellness information
- Administrative support for test ordering and result delivery
IMPORTANT MEDICAL DISCLAIMER: Neither AllrangeKit™ nor the Platform provides medical advice, diagnosis, or treatment. The Platform enables access to laboratory testing services and healthcare providers, but it is the Labs and Practitioners who furnish all medical services to you. You are not entering into a provider-patient relationship with AllrangeKit™. Our test results are for informational and screening purposes only and should not be used as the sole basis for medical decisions. Always consult with a qualified healthcare provider for medical advice, diagnosis, and treatment.
2. ADDITIONAL TERMS AND CONDITIONS
Your use of the Platform is also governed by:
- Specific Terms Relating to Lab Services and Products
- Our Privacy Notice (for general personal information)
- Our HIPAA Notice of Privacy Practices (for health information)
- Our Consumer Health Data Privacy Notice (for residents of Washington and Nevada)
- Test-specific consent forms and authorizations
- Any additional terms presented during service delivery
In the event of a conflict between these Terms and any Additional Terms and Conditions specifically applicable to a Service, the Additional Terms will control for that specific Service only.
3. ELIGIBILITY AND AVAILABILITY
To use our Services, you must:
- Be at least 18 years of age
- Be a resident of the United States in a state where our Services are available
- Have the legal capacity to enter into binding contracts
- Provide accurate, current, and complete information
- Have a valid U.S. shipping address
- Not be using the Services on behalf of another person (unless authorized)
State Availability: Our Services are not available in all states due to varying regulatory requirements. Some states require additional physician involvement or prohibit direct-to-consumer testing. We will notify you during checkout if Services are not available in your state.
International Restrictions: Our Platform and Services are intended only for use within the United States. International users should not access or use our Services. We do not ship internationally.
4. ACCOUNT REGISTRATION
Account Requirements:
To use our Services, you must create an account ("Account") and provide:
- Valid email address
- Secure password meeting our security requirements
- Full legal name (must match payment method)
- Date of birth (to verify age)
- Shipping address
- Phone number
- Payment information
Account Security:
- You are responsible for maintaining account confidentiality
- Do not share your login credentials
- Notify us immediately of unauthorized access
- Log out after each session, especially on shared devices
- We may suspend accounts that pose security risks
Account Accuracy:
- All information must be accurate and current
- You must update information when it changes
- Providing false information may result in account termination
- You may not create multiple accounts
5. LABORATORY TESTING SERVICES
A. Overview
Our at-home testing services allow you to collect samples privately and send them to certified laboratories for analysis. These services are for health screening and informational purposes only, not for diagnosing or treating diseases.
B. Test Authorization and Clinical Oversight
- All tests require review and authorization by a licensed healthcare provider
- We work with independent practitioners to review test appropriateness
- Tests may be denied if not medically appropriate for you
- Some states have additional requirements for test authorization
C. Sample Collection Requirements
By using our test kits, you agree to:
- Follow all collection instructions exactly
- Collect only your own samples (not another person's)
- Use clean collection techniques
- Complete collection within kit expiration dates
- Return samples promptly using provided materials
- Not tamper with or contaminate samples
- Understand that improper collection may lead to invalid results
D. Test Limitations and Accuracy
You understand and acknowledge that:
- No test is 100% accurate
- False positives and false negatives can occur
- Test accuracy depends on proper sample collection
- Window periods affect disease detection
- Results are screening only, not diagnostic
- Positive results require confirmatory testing
- We do not guarantee any specific results
E. Result Delivery
- Results typically available as soon as testing is complete
- Results delivered through your secure account
- You are responsible for checking results
- We may attempt to contact you for critical values
- Results are not sent via unencrypted email
- You should discuss all results with your healthcare provider
F. Follow-Up Care
- Positive or abnormal results require medical follow-up
- We may provide educational resources but not treatment
- Telehealth consultations may be available for result review
- You are responsible for seeking appropriate medical care
- Emergency symptoms require immediate medical attention (call 911)
6. PRODUCT ORDERS AND PURCHASES
A. Ordering
- All orders subject to acceptance by us
- We may limit quantities or refuse orders
- Prices subject to change without notice
- We may require additional verification
- Orders may be cancelled by either party before shipment
B. Pricing and Payment
- Prices in U.S. dollars
- Payment due at time of order
- We accept major credit/debit cards
- Payment processed by secure third-party processors
- You authorize charges for all amounts due
- We may correct pricing errors
C. Taxes and Fees
- You are responsible for applicable taxes
- Shipping fees displayed during checkout
- No hidden fees
D. Shipping
- U.S. shipping only
- Shipping times are estimates only
- Risk of loss transfers upon delivery to carrier
- You must provide accurate shipping information
- Signature may be required for delivery
- We are not responsible for shipping delays
E. Returns and Refunds
Unopened Kits:
- 30-day return window from delivery
- Must be unopened and unused
- Original packaging required
- Shipping costs non-refundable
- Refund processed after inspection
Opened/Used Kits:
- Cannot be returned for health and safety reasons
- No refunds after sample collection begins
- No refunds for user error in collection
Defective Products:
- Report within 7 days of receipt
- We will replace at no cost
- Photo evidence may be required
Refund Timing:
- Processed within 10 business days
- May take additional time to appear on statement
7. HEALTH INFORMATION PRIVACY
Your health information is protected by:
- HIPAA (Health Insurance Portability and Accountability Act)
- State health privacy laws
- Our HIPAA Notice of Privacy Practices
By using our Services, you acknowledge that:
- Health information will be shared with Labs and Practitioners
- Results may be reported to public health authorities as required by law
- You have reviewed our HIPAA Notice of Privacy Practices
- You consent to the use and disclosure of health information as described
8. TELEHEALTH SERVICES
If you use telehealth services through our Platform:
- Services provided by independent licensed practitioners
- Not available for emergencies
- Technical requirements must be met
- You must ensure privacy on your end
- Services subject to state licensing requirements
- Separate telehealth consent required
9. MEDICAL DISCLAIMERS AND WARNINGS
IMPORTANT WARNINGS:
- NOT FOR MEDICAL EMERGENCIES - CALL 911
- Results are not diagnostic
- Do not change medications based on results alone
- Do not ignore symptoms while awaiting results
- Seek immediate care for urgent symptoms
- Results do not replace regular medical care
- Not all conditions can be detected by testing
- Testing has inherent limitations
10. INTELLECTUAL PROPERTY
A. Our Property
All Platform content, including text, graphics, logos, images, software, and compilations, is owned by or licensed to us and protected by intellectual property laws.
B. Limited License
We grant you a limited, revocable, non-exclusive license to access and use the Platform for personal, non-commercial purposes only.
C. Restrictions
You may not:
- Copy, modify, or distribute our content
- Use our trademarks without permission
- Reverse engineer our systems
- Scrape or data mine our Platform
- Create derivative works
- Remove copyright notices
D. User Content
By submitting content, you grant us a worldwide, royalty-free, perpetual license to use it for our business purposes. You represent that you have rights to any content you submit.
11. PROHIBITED USES
You agree not to:
- Violate any laws or regulations
- Provide false information
- Submit another person's sample as your own
- Impersonate another person
- Use the Services for illegal purposes
- Interfere with Platform operation
- Attempt to gain unauthorized access
- Harass or harm others
- Post inappropriate content
- Resell or commercialize our Services
- Circumvent security measures
- Use automated systems without permission
12. PRIVACY AND DATA SECURITY
A. Privacy Policies
Your information is governed by:
- Privacy Notice (general data)
- HIPAA Notice (health information)
- Consumer Health Data Notice (where applicable)
B. Data Security
- We use industry-standard security measures
- No transmission method is 100% secure
- You are responsible for account security
- Report security concerns immediately
C. Communications
By providing contact information, you consent to receive:
- Transactional communications
- Service-related notices
- Test result notifications
- Marketing (with separate opt-in consent)
13. THIRD-PARTY SERVICES
A. Laboratory Partners
- Independent CLIA-certified laboratories
- Separate entities from AllrangeKit™
- We are not responsible for lab errors beyond our reasonable control
B. Healthcare Providers
- Independent licensed practitioners
- Not employees of AllrangeKit™
- Professional medical judgment is independent
C. Payment Processors
- Third-party payment processing
- Subject to processor's terms
- We do not store full payment information
14. WARRANTIES AND DISCLAIMERS
THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF RESULTS
- UNINTERRUPTED SERVICE
- ERROR-FREE OPERATION
- SECURITY OF DATA
We do not warrant that:
- TESTS WILL DETECT ALL CONDITIONS
- RESULTS WILL BE ACCURATE OR RELIABLE
- SERVICES WILL MEET YOUR NEEDS
- PLATFORM WILL BE ERROR-FREE
- SECURITY MEASURES ARE IMPENETRABLE
- THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE
- DEFECTS WILL BE CORRECTED
- PLATFORM IS FREE OF VIRUSES OR HARMFUL COMPONENTS
15. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALLRANGEKIT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, LABORATORIES, AND HEALTHCARE PROVIDERS SHALL NOT BE LIABLE FOR:
A. Excluded Damages:
- Indirect, incidental, or consequential damages
- Lost profits or revenue
- Loss of data
- Emotional distress
- Punitive damages
- Costs of substitute services
B. Cap on Liability:
Our total liability shall not exceed the amount you paid for the specific Service giving rise to the claim.
C. Exceptions:
Some jurisdictions do not allow limitation of certain damages, so some limitations may not apply to you.
THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
16. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless AllrangeKit™ and its affiliates, officers, directors, employees, agents, laboratories, and healthcare providers from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another
- Your submission of another person's sample
- Your misuse of test results
- Your false or misleading information
- Your failure to follow instructions
17. TERM AND TERMINATION
A. Term
These Terms are effective when you accept them and continue until terminated.
B. Termination by You
You may terminate by:
- Closing your account
- Ceasing use of Services
- Contacting customer support
C. Termination by Us
We may terminate or suspend your access immediately for:
- Violation of Terms
- Illegal activity
- Risk to others
- False information
- Any reason at our discretion
D. Effect of Termination
Upon termination:
- Access to Services ends
- Pending orders may be cancelled
- No refunds for completed services
- Some provisions survive termination
18. MODIFICATIONS TO TERMS
We may modify these Terms at any time by:
- Posting updated Terms on Platform
- Notifying you of material changes
- Requiring acceptance for continued use
Your continued use after changes constitutes acceptance. If you disagree with changes, stop using our Services.
19. GOVERNING LAW
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal action not subject to arbitration must be brought in courts located in Los Angeles County, California.
20. DISPUTE RESOLUTION
A. Informal Resolution
Before formal proceedings, attempt to resolve disputes by contacting:

B. Binding Arbitration
If informal resolution fails, any dispute, claim, question, or disagreement (“Dispute”) arising from or relating to these Terms, the Platform, or the Services, shall be resolved through confidential, binding arbitration administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures (the “JAMS Rules”) and in accordance with the Expedited Procedures in those Rules (available at www.jamsadr.com). If, for any reason, JAMS is unable to administer the arbitration, then except as otherwise stated below, you or we may file a Dispute with any national provider of arbitration services that handles consumer arbitrations following procedures that are substantially similar to the JAMS Expedited Procedures in the JAMS Comprehensive Arbitration Rules.
The venue for all such Disputes shall be located in Los Angeles County, California. You hereby waive any right to claim that such location is an inconvenient forum and covenant not to sue us in any other forum. This agreement to arbitrate will be specifically enforceable in any court having jurisdiction. Notice of a demand for arbitration shall be filed in writing with the other party hereto and with the JAMS. Such a notice should be mailed to:

The demand for arbitration shall be made within a reasonable time after the dispute has arisen, and in no event shall any such demand be made after the date when institution of legal or equitable proceedings based on such dispute would be barred by the applicable limitations period. The parties agree that one (1) arbitrator shall arbitrate the Dispute. The arbitrator shall be selected by the joint agreement of the parties, but if they do not so agree within twenty (20) days after the date of the notice of a demand for arbitration referred to above, the selection shall be made pursuant to the Rules of the JAMS. The parties agree that the arbitrator shall have sole authority to decide whether claims brought by either party (excluding claims brought under the following paragraph regarding intellectual property and preliminary equitable relief claims) are subject to this dispute resolution agreement. The decision of the arbitrator shall be made in writing, shall be final, judgment may be entered upon it in any court having jurisdiction thereof, and the decision shall not be subject to vacation, modification or appeal, except to the extent permitted by sections 10 and 11 of the Federal Arbitration Act, the terms of which sections the parties agree shall apply.
Other than the exceptions listed herein, the arbitrator will have the power to grant whatever relief would be available in court under law or in equity (including attorney's fees) and any award of the arbitrator will be final and binding on each of the parties. The arbitrator will not, however, have the power to award punitive or exemplary damages, the right to which each party hereby waives. The arbitrator also does not have the power to vary the class action waiver provisions.
The fees charged by the JAMS and arbitrator shall be shared equally by the parties. All arbitration proceedings will be confidential and all records relating thereto will be permanently sealed to the fullest extent possible under applicable law.
Either party may bring a claim related to intellectual property rights, seek temporary or preliminary specific performance or temporary or preliminary injunctive relief, or seek to bring an individual action in small claims court (provided such claim qualifies to be filed in small claims court), in any court of competent jurisdiction, without the posting of bond or other security). If any term, clause or provision of this Section is held invalid or unenforceable, it will be so held to the minimum extent required by law, and all other terms, clauses and provisions of this section will remain valid and enforceable. Further, the waivers set forth in this section are severable from the other provisions of these Terms and Conditions and will remain valid and enforceable, except as prohibited by applicable law.
C. Arbitration Exceptions:

- Injunctive relief for Intellectual Property violations
- Claims that cannot be arbitrated under law
21. CLASS ACTION WAIVER
YOU AND ALLRANGEKIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. NO ARBITRATOR OR JUDGE MAY CONSOLIDATE CLAIMS OR OTHERWISE PRESIDE OVER A REPRESENTATIVE OR CLASS PROCEEDING.
22. TIME LIMITATION
ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OR SUCH CLAIM IS PERMANENTLY BARRED.
23. GENERAL PROVISIONS
A. Entire Agreement
These Terms, along with referenced policies, constitute the entire agreement between you and AllrangeKit™.
B. Severability
If any provision is invalid, the remaining provisions continue in effect.
C. No Waiver
Our failure to enforce rights is not a waiver.
D. Assignment
We may assign these Terms. You may not assign without our consent.
E. Force Majeure
We are not liable for delays due to causes beyond our reasonable control.
F. Electronic Communications
You consent to electronic communications and agree they satisfy legal writing requirements.
G. Interpretation
Headings are for convenience only. "Including" means "including without limitation."
H. Relationship
Nothing creates an agency, partnership, or employment relationship.
I. Export Control
You agree not to export products in violation of U.S. laws.
J. Survival
Provisions that should survive termination will survive.

We strive to make our Platform accessible to individuals with disabilities. For assistance or to report accessibility issues, contact us at cs@ohcus.com.
25. CALIFORNIA RESIDENTS
If you are a California resident, you have specific rights under California law, including:
- The right to request information about our data practices
- The right to opt-out of the sale of personal information
- Additional rights under the California Consumer Privacy Act (“CCPA”)
